Integrating Rule of Law: New Solutions to the Global Displacement Crisis



In the recent International Law News article Integrating Rule of Law: New Solutions to the Global Displacement Crisis, ABA ROLI's expert, Paulina (Paula) Rudnicka, discusses the importance of elevating the rule of law discourse in the context of forced migration, particularly in light of ongoing efforts to adopt two new global compacts: one on migration and one on refugees. Rudnicka argues that “rule of law development is indispensable both to the prevention and resolution of forced migration and to the protection of people who flee,” and identifies four rule of law approaches to displacement: building just legal systems, promoting good governance, strengthening accountability mechanisms, and ensuring empowered protection. She emphasizes that new solutions to the global displacement crisis must be people-centered, gender-sensitive, and based on the universal principles of human rights.

This insightful article, published by the ABA Section of International Law, comes nearly a month after ABA ROLI's Annual Rule of Law Luncheon, which examined the root causes of forced migration, and how the global legal community can respond. The article and the luncheon discussion are a continuation of ABA ROLI’s project When People Flee: Rule of Law and Forced Migration, which culminated in April with the 2018 Conference on Contemporary Rule of Law Issues. Rudnicka is the co-author of ABA ROLI's issue paper, published as a complement to the conference.
